Praktek Islah Dalam Pembagian Waris (Studi Kasus di Keluarga Muslim Sasak Lombok Timur)

Abstract

The Sasak Muslim community in East Lombok Regency has a way of solving the problem of inheritance or assets to
be left behind. Even though the majority are Muslim, the distribution of inheritance does not fully apply Islamic law.
But they use the peace system (islah). Islah is an agreement to resolve the problem of inheritance distribution
peacefully. This study aims to find out how the practice of islah division of inheritance, the supporting and inhibiting
factors of islah, the legal strength of the results of islah in East Lombok Sasak Muslims. This field research used a
qualitative approach, the analytical method used sociological descriptive analysis, primary and secondary data
research, data collection through observation, interviews and documentation.
Based on the results of the study that: The practice of islah distribution of inheritance for Sasak Muslims is carried
out closed and open. Factors supporting and inhibiting islah in the distribution of inheritance are cultural factors of
the Sasak people, kinship, science and economics. The maximum legal power of islah is valid if the islah is stated in
an authentic deed so that it becomes strong evidence in court and can prevent disputes in the future.
