ANALISIS PENEGAKAN HUKUM TERHADAP PENYALAHGUNAAN DANA DESA DALAM PEMBANGUNAN DESA (STUDI PUTUSAN NOMOR : 13/PID.SUS-TPK/2020/PN.TJK)

Abstrak

Corruption is an extraordinary crime that has destroyed the foundations of the economy and resulted in the downturn of the Indonesian economy and has afflicted all levels of society. The aim is to find out, understand and analyze the factors causing the perpetrators of the crime of village funds in village development and to analyze the judges in deciding cases against the perpetrators of the crime of village funds in the village. The research method used is normative research. The factors that cause a person to commit a crime or criminal act can basically be caused by 2 (two) things, namely, factors from within the perpetrator such as the state of the soul, intentions, habits. Judge's consideration, The judge's decision is the culmination of a case that is being examined and tried by the judge. The judge gives his decision regarding the following matters, the decision regarding the incident, whether he has committed the act he is accused of. The definition of corruption in a broad sense is actions that are detrimental to finances and the economy which can be studied and punished based on the applicable laws and regulations.
